The categories of the information that we collect, process, hold and share include:

CCTV footage of individuals is classed as personal data where an individual can be identified.  This can include all types of data subject, from members of staff, other agency staff, contractors who visit our sites and members of the public.

Why we collect and use this information

We have CCTV installed outside our buildings and fire stations for the purposes of public and staff safety, crime prevention through deterrence and detection, accident and incident investigation.

We also have mobile CCTV and data recorders mounted on AF&RS vehicles, which is used for accident and incident investigations, identifying engine emissions, fuel consumption, vehicle mileage and driving hours, public and staff safety, crime prevention through deterrence and detection, Fire Investigation, providing a pool of learning experiences for training purposes which will assist in improving operational tactics and command, reducing insurance claims and associated insurance premiums where possible

Decisions are made on a case by case basis regarding the use of the footage and in accordance with the CCTV Policy.

The lawful basis on which we use this information

The Fire and Rescue Service Act 2004 makes it a requirement that we secure the provision of the personnel, services and equipment necessary to efficiently deliver a Fire and Rescue Service. As an employer, we have an obligation to safeguard our employees and to comply with the various Health & Safety legislation.

Under the General Data Protection Regulation (GDPR) our lawful basis on which we collect and use this information will depend on the reason for its use, such as:

  • it is necessary for the performance of a task carried out in the exercise of our official authority as a Fire and Rescue Service (Article 6, 1 (e)) to facilitate our operational staff training, operational tactics, efficient/safe use of Fire Service resources and equipment, and Fire Investigation activities;
  • it is our legal obligation  to comply with Health and Safety Legislation (Article 6, 1 (c)) for the investigation of an incident involving the health, safety and welfare of our staff or individuals visiting our premises;

it is for our own legitimate interests (Article 6, 1 (f)) for the protection of ourproperty, other assets, reducing our insurance claims, and for investigation of crime (which could extend to the legitimate interests of a third party), whilst balancing the rights and expectations of the individuals captured by the CCTV.

Any personal information obtained for the above activities will only be used for these purposes unless other legislation dictates that further processing is necessary and lawful.

Collecting this information

We do not perform any covert surveillance. All buildings where CCTV is fitted will display awareness signs, this will also extend to signage on all Service vehicles that have mounted CCTV equipment.

Storing this information

All CCTV images are recorded locally. The retention of CCTV images is limited by the

capacity of the recording media at each site, which ranges from 2 weeks to several months.

Over time, images are deleted once the capacity of each device is reached. On occasions there may be a need to keep images for longer, for example where a crime or a Health & Safety incident is being investigated, in which case they are downloaded and stored securely on AF&RS premises.

In the event that data is downloaded and retained as media evidence, it will be treated in

accordance with guidance from the Home Office.

Who we share this information with and why

We disclose CCTV footage to third parties such as an Enforcing Authority as part of a criminal investigation, which we do so in accordance with the codes of practice issued by the Information Commissioner and the Home Office.

Decisions are made on a case by case basis regarding the sharing of the footage and in accordance with the CCTV Policy and data protection law.
